These Terms and Conditions (“Terms”) govern your access to and use of services provided by Elate Occasions (“Company,” “we,” “us,” or “our”), including the rental and operation of photo booths for private and public events. By booking services or accessing our website, you agree to be bound by these Terms.

1. Use of Services

Elate Occasions provide digital photo booth rentals and related services for events. By booking with us, you agree to use our services in compliance with these Terms and applicable laws.

2. Booking & Payment

All event bookings require accurate information regarding the event date, time, location, and contact details. A non-refundable deposit is required to secure your reservation. The remaining balance is due [14 days] prior to the event unless otherwise agreed in writing. Payment methods accepted include online payment, bank transfer, Zelle, Venmo, or as specified during booking.

3. Cancellation & Refund Policy

Cancellations must be submitted in writing via email. Deposits are non-refundable. Cancellations made less than 24 hours before the scheduled event may be subject to additional cancellation fees. Refunds, if applicable, are processed at our discretion according to our policy.

4. Client Responsibilities & Equipment Use

Clients and their guests are expected to treat all photo booth equipment with care. Any intentional damage, misuse, or loss of equipment during the rental period will result in the client being held financially responsible for repair or replacement costs.

5. Photo & Video Use (Media Release)

Unless otherwise requested in writing, you grant Elate Occasions the right to use any photos, videos, or media captured during the event for marketing, portfolio, or promotional use, including online and printed materials.

6. Liability Disclaimer

Elate Occasions is not liable for any injury, property damage, or loss incurred during or after the use of our services. We are not responsible for equipment malfunctions due to venue power outages, interference by guests, or other external factors beyond our control.

7. Indemnification

You agree to indemnify and hold harmless Elate Occasions, its employees, contractors, and affiliates from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of our services, venue conditions, or breach of these Terms.

8. Intellectual Property

All logos, brand assets, designs, templates, and website content are the property of Elate Occasions and may not be used, copied, or reproduced without written permission.

9. Governing Law

These Terms are governed by the laws of the State of California. Any disputes will be subject to the exclusive jurisdiction of the courts in Orange County, California.

10. Changes to Terms

We reserve the right to update or modify these Terms at any time. Continued use of our services or website after such updates constitutes acceptance of the revised Terms.
